Krome Studios is Australia’s largest independent video game developer with offices in Brisbane, Melbourne and Adelaide. We create games distributed on video game consoles such as Sony PlayStation 3, Microsoft Xbox 360 and the Nintendo Wii. We also create games that you have downloaded or may be about to download through our website, social networking sites (e.g. Facebook) and online digital distribution channels (e.g. Sony PlayStation Network and Microsoft Xbox Live Arcade). Krome Studios, sometimes referred to as Krome Group, is comprised of Krome Studios Pty Ltd (ACN 089 762 783), Krome Development Pty Ltd (ACN 091 041 146) and Krome Technologies Pty Ltd (ACN 091 355 930) (collectively “Krome”) is committed to protecting the privacy of all people who interface with our products and our website.
Being an Australian company, we comply with Australia’s Privacy Act 1988 (Cth) as amended to 14 September 2006 and follow the ten National Privacy Principles from Schedule 3. Please see its accompanying information sheet for more information.
Additionally, we seek to comply with acts from the United States of America, which are: COPPA, the United State’s Children’s Online Privacy Protection Act, and CAN-SPAM, which covers the transmission of commercial email messages with the primary purpose of advertising or promoting a product. For European residents, we also seek to follow the E.U. Data Protection Directive (95/46/EC) Chapter 1, Article 6, and also the Directive on Privacy and Electronic Communications (2002/58/EC).
This Privacy Notice outlines how we intend to collect, use and manage the protection of your personal information. Please read this Privacy Notice, and contact us if you have any questions. By accessing this website and/or using any of Krome’s interactive software products (collectively “Games”), you agree that we may collect, use and process your data in accordance with this Privacy Notice. If you do not agree to this Privacy Notice please do not use this website and/or any Games.
We may update this Privacy Notice and if we do, we will post a notice on www.kromestudios.com that changes have been made.
In the course of conducting business as a developer of computer games, we may occasionally receive direct correspondence in the form of written letters and/or telephone calls in which you may disclose personal identifiable information, such as names, emails, postal addresses, and/or telephone calls with names and numbers to return calls. We use this information to respond to your correspondence or call, and will log the contact and any information provided in a password protected database on our secure servers which has restricted access. We will not send you any marketing or other communication without your explicit consent or request to do so, with the exception of messages sent through channels you have signed-up for on this website (e.g. E-mail newsletters) and/or in connection with one of our Games (e.g. Fan Pages or status updates on social networking sites).
Occasionally, we display correspondence in our offices for employees to appreciate your comments about Krome and our Games. When we do so, we remove or blackout any personally identifiable information, with the exception of a first name and country of origin (if provided). For example, “Mike, Australia”.
When you accept or install our Games through social networking sites (e.g Facebook, MySpace, etc.), we collect what is known as “General Information” provided by the social networking site which we use to enable your use of the Game. General Information may include: user ID, name, email, gender, birthday, profile picture URL, and the user IDs of your friends. We do not collect your current geographical location. All General Information is used for the primary purpose of providing the Game service.
On occasion we may also use your General Information and/or newsletter subscriptions for the secondary purpose of notifying you of service notices (like an updated privacy notice), new product releases, and to ask for your input and opinions about our Games.
During the process of playing our Games through social networking sites you may choose to share personal information about yourself through the Game. Please be careful to use discretion as personal information shared with other players is visible to the public and will not be kept private. Based on the related terms of use on your social networking site account, actions that are designated visible for “everyone” may be collected by us. When friends invite you to play one of our social networking site Games, or vice versa, we may collect the email addresses, content and other data from those messages in order to send up to two (2) invitation reminders.
Finally, we may collect and look at combined non-personally identifiable data of players’ activities, including but not limited to session lengths, browser versions and click-thru rates on features or third party services in order to improve the Game experience. By downloading or using our Games, you consent to our collection and use of such non-personally identifiable data beyond the cancellation or deletion of the Game on your account.
We sometimes display correspondence within our common areas, but not without first removing personally identifiable information as outlined above. Krome employees, and sometimes building managers, media and other visitors use our common areas. When it comes time to throw away any physical correspondence from fans, we seek to ensure their personally identifiable information cannot be retrieved by shredding it.
We share statistics of each user’s activities and data within reports that are used internally and sometimes externally to analyze the Game, its features and performance. Similarly, we may also quote from a forum post, news feed, or show a screenshot from a user’s Game session without prior notice to you provided that we are not disclosing any personally identifiable information.
Unless we are required to provide your personal information to others by law, by court order, or to investigate suspected fraud or other unlawful activity, your personally identifiable information will only be seen or used by persons working in or for the Krome Group.
We do not sell or rent your personally identifiable information to any third party, although non-personally identifiable information may be used to assist advertisers in targeting their services to specific user demographics. For example, we may provide third party advertisers with the aggregate number of males of a certain age in a specific country who are playing one of our Games.
We may transfer your personally identifiable information in the event another entity a merges with or acquires substantially all of Krome’s assets or in the event we license or transfer the operation of one of our Games to another company. In either event, we will post a notice prior to the transfer of your personally identifiable information in an updated Privacy Notice on this website and if possible within the Game.
We may share certain General Information about you with our partners in order to support the Game, solve or fix any errors related to our social networking site Games, however we shall not transfer any rights to use or further share your General Information.
We use Google and other third party servers to host some or all of our Games, and our own servers at Krome’s facilities in Australia to store information and archives. Google’s and other third party servers may be located in diverse geographic areas located outside of Australia. These are all secure servers, protected by firewalls.
By downloading or using our Games, you consent to having your General Information and non-personally identifiable user activity data transferred and processed on servers primarily located in Australia and the United States.
We do not ask you to provide any “sensitive information” as a requirement to use our website or any of our Games. Sensitive Information that you disclose to “everyone” on a discussion forum or through a social networking site in connection with a Game may be collected and held by us in accordance with this Privacy Notice. We do not use or share Sensitive Information with third parties. Sensitive Information is defined as any personal information related to health, race, ethnicity, political views, religion, professional status, philosophical view, and trade or union affiliation. Please contact us if you have any questions or concerns about any Sensitive Information that you may have disclosed to Krome or to other users during the use of a Game that we may have collected. We do collect non-personally identifiable information regarding Game usage including but not limited to, top country, city and language by aggregate usage as provided by the social networking sites.
Subject to any legal restrictions, we would be happy to advise you what personally identifiable information we hold about you if you request it. If your request is particularly complex or requires detailed searching of our records, there may be a cost to you in order for us to provide you with this information.
You have the ability to opt-out of: receiving information and marketing emails from us; publishing your recent Game activity to your social networking site page; bookmarking or displaying the Game page to others, and of course the ability to delete our Game and rescind any permissions required to operate such Game, at any time.
It is our responsibility to keep accurate, complete and up-to-date records, so any changes you make in the Game regarding your personally identifiable information will go into effect as quickly as technically possible. Subject to any legal limitations, when you delete our Game we endeavor to destroy the General Information we received from the social networking site when you accepted our terms and began playing the Game. We reserve the right to retain the non-personally identifiable data collected during your use of the Game.
We also reserve the right to delete messages, content and accounts in whole or in part, at our discretion, that we find offensive to the general public, uses profanity in any of our public forums, causes complaints from other users, is not suitable for a general audience or infringes the intellectual property rights of any third party. For example, talk of drugs, alcohol, violence, strong language, gambling, crude humor, sexual themes or is suggestive in nature is prohibited.
Krome does not knowingly collect online personal information from children under the age of 13, and if you are under the age of 13 you are not allowed to play our Games or register with our website without parental consent. If we discover that personal information is the information of a child under 13, we will attempt to delete the information as soon as possible. We encourage parents to spend time online with their children. We urge parents to instruct their children to never give out their real names, e-mail addresses or phone numbers without parental permission when using the Internet.
If you believe that we have collected information on a child under the age of 13 from the internet via our Games, newsletters or website, we ask that you contact us so that we can delete that information or to provide parental consent. Cookies are small files applied to your Internet browser to track movements within websites. We may link cookie information to personally identifiable information. Some of our Games may use an outside ad company to display ads. These ads contain cookies. Cookies received with banner ads are applied by our ad companies, and Krome does not have access to this information. Most browsers are automatically set to accept cookies whenever you visit a website. You can disable cookies or set your browser to alert you when cookies are being sent.
Please note that this Privacy Policy covers the use of cookies by Krome only and does not cover the use of cookies by any advertisers who may link to our website or Games.
Krome’s website and Games may contain advertising or services which link to other websites such as Twitter, Facebook and Apple. The fact that we link to a website is not an endorsement, authorization or representation of our affiliation with that third party. If you click on a link to a third party site, including on an advertisement, you will leave our website or the Game you are playing and go to the site you selected. Because we cannot control the activities of third parties, we cannot accept responsibility for any use of your personal information by such third parties, and we cannot guarantee that they will adhere to the same privacy and security practices as Krome. We encourage you to review the privacy policies of any other service provider from whom you request services. If you visit a third party website that is linked to our website or Games, you should consult that website’s privacy policy before providing any personal information.
